Privacy policy

This policy covers the software published by Apex Labs Limited — Waka, Kaha, and Tohe — and this website. The short version: our apps are built to keep your data on your device and in your own iCloud, we don't run accounts, and we don't sell or share personal information.

Principles shared by all our apps

No accounts, no profiles

None of our apps require an account, sign-in, or registration. We do not build profiles of our users.

Your data stays yours

Data our apps create or read — locations, sensor readings, workouts, training history — is processed and stored on your device, and where an app offers sync (such as Tohe), it syncs through your own iCloud account using Apple's infrastructure. It is not transmitted to Apex Labs.

No advertising, no analytics, no tracking

Our apps contain no advertising and no third-party analytics or tracking SDKs. We do not sell, rent, or share personal information with anyone.

Waka

Location and instrument data

Waka uses your device's location and motion sensors, and data from your boat's instruments (such as wind, speed, depth, and AIS receivers on your own network) to provide navigation features. This data stays on your device.

Weather and marine data requests

To show forecasts, Waka requests weather, wave, and marine data from third-party services (including Open-Meteo and Apple Weather). These requests necessarily include the geographic area you are viewing or planning in, which the service needs in order to answer. We don't send anything else about you with these requests.

Internet AIS

If you enable internet-sourced AIS traffic, Waka subscribes to an AIS data service (aisstream.io) for the geographic region around your position or viewing area. As with weather, the region is inherent to the request. Vessel positions shown from this source are data those vessels already broadcast publicly on marine VHF.

Kaha and Tohe

Health and workout data

Kaha and Tohe read from and write to Apple Health (HealthKit) with your explicit permission — things like workouts, heart rate, and training load — to plan and track your training. Health data is handled under Apple's HealthKit rules: it stays on your device and in your own encrypted iCloud, is never transmitted to Apex Labs, and is never used for advertising or shared with third parties.

Apple Watch

Tohe hands workouts to your Apple Watch through Apple's own workout frameworks. The workout data your watch records belongs to Apple Health on your devices, as above.

Beta testing

If you join a beta through Apple's TestFlight, Apple provides us with crash logs and basic usage statistics as described in TestFlight's own terms, and shares with us the email address you use for TestFlight so we can correspond with you about the beta. We use this information only to run the beta programme.

This website

apexlabs.co.nz is a static website. It sets no cookies, runs no analytics, and loads no third-party fonts or scripts. It is hosted on GitHub Pages, whose servers may log requests (such as IP addresses) as part of ordinary web hosting; see GitHub's privacy statement for details.

Email

If you email us, we'll have your email address and whatever you send us. We use it to reply and keep support correspondence. We don't add you to marketing lists.

Your rights

Apex Labs Limited is a New Zealand company, and we handle personal information in accordance with the New Zealand Privacy Act 2020. Since our apps keep your data on your device, in most cases the information we hold about you is limited to email correspondence. You can ask us what we hold, ask for corrections, or ask us to delete it — email ben@apexlabs.co.nz.

Changes

If our apps' data practices change — for example, if a future feature needs something not described here — we will update this policy and change the effective date above before the change ships.
